Scope of Application

These General Terms and Conditions (GTC) apply to all offers and services of INKONTAKT Gestaltinstitut Berlin, including:

  • training and further education programmes
  • one-day workshops, events, and information sessions
  • supervision services
  • room rentals
  • mediation services within the Gestalt Ambulance

Deviating terms and conditions of participants or professionals shall not be recognised unless the Institute expressly agrees to their validity in writing.

General Terms and Conditions (GTC)

Contractual Partner & Legal Form

  1. The contractual partner for all training programmes, workshops, rentals, and Ambulance mediation services is:
    INKONTAKT Gestaltinstitut Berlin, sole proprietorship, Gleimstr.37, 10437 Berlin, represented by Gabriele Blankertz.
  2. With regard to therapeutic or counselling services provided within the framework of the Ambulance, the Institute is not a contractual party of the clients. The contract is concluded exclusively between the client and the respective professional.

Registration & Conclusion of Contract

Training Programmes / Ambulance Professionals
  1. Registration is carried out via the designated registration forms.
  2. The contract is concluded once the Institute confirms the registration in writing.
One-day Workshops, Events, Information Sessions
  1. Registration may be made informally, orally or by email.
  2. Registration becomes binding once:
    ◦ the Institute confirms the place, and
    ◦ payment has been received.
  3. The GTC apply as referenced prior to or at the time of registration.
Ambulance – Clients
  1. Clients do not enter into a contract with the Institute but receive exclusively mediation to a professional.
  2. The contract between the client and the professional is concluded upon appointment scheduling.
Prices & Payment Terms
  1. The Institute’s prices are exempt from value-added tax pursuant to Section 4 No. 21/22 of the German VAT Act (UStG).
    No VAT is charged.
  2. Payments are to be made by bank transfer.
  3. Training programmes: payment by the 20th of the month or as otherwise agreed.
  4. Workshops/events: payment within 7 days, at the latest prior to commencement.
  5. Instalment payments are possible only for training programmes and subject to prior agreement.
  6. Discounts may be granted in individual cases; there is no entitlement to a discount.
Right of Withdrawal
  1. For registrations made by email or online form, a statutory right of withdrawal of 14 days applies (Sections 312g, 355 German Civil Code – BGB).
  2. The right of withdrawal expires pursuant to Section 356(4) BGB if participants:
    ◦ expressly agree that the Institute begins performing the service before expiry of the withdrawal period, and
    ◦ confirm that they are aware that the right of withdrawal expires upon commencement of performance.
  3. For services provided on a fixed date (e.g. workshops, seminars, events), no right of withdrawal exists once performance has begun following such consent.
  4. If no express consent pursuant to Section 356(4) BGB is given, the right of withdrawal remains in effect until expiry of the statutory 14-day period and expires at the latest upon full performance of the service.
Withdrawal, Cancellation & Rebooking
  1. Training Programmes
    The provisions of the respective training contract apply.
  2. Workshops, Short Formats & Events
    • Upon binding registration, the participation fee becomes due.
    • Cancellation is generally excluded; however, participants may designate a substitute participant at any time.
    • Rebooking to another date or format may be granted upon request and at the Institute’s discretion.
  3. Professionalisation Package (Ambulance Professionals)
    • Termination at the end of a calendar quarter with one month’s notice.
Participation Requirements, Conduct & House Rules
  1. Participants are expected to arrive on time and actively participate in the programme.
  2. Absences from training programmes must be reported and may need to be made up for a fee.
  3. House rules include:
    ◦ respectful interaction
    ◦ no audio or video recordings without the consent of all parties involved
    ◦ no alcohol or drug influence during events
    ◦ careful participation in physical exercises; instructions by trainers must be followed
  4. Language skills: sufficient proficiency in the language of the respective event is required.
Confidentiality
  1. All participants are obliged to maintain confidentiality regarding personal content of other individuals shared in group or individual settings.
  2. This applies to training programmes, workshops, supervision sessions, and events.
Rights & Obligations of the Institute
  1. The Institute may postpone or cancel events for good cause (e.g. insufficient number of participants, illness of lecturers, force majeure).
  2. In the event of cancellation by the Institute, participation fees will be fully refunded or an alternative date will be offered.
  3. Lecturers may vary for organisational reasons.
Liability
  1. The Institute is liable only for damages resulting from intent or gross negligence.
  2. In particular, no liability is assumed for:
    ◦ cloakroom items and valuables
    ◦ external events or cooperations
    ◦ premises used by third parties, except in cases of breach of duty by the Institute
  3. The Institute is not liable for physical or health-related damages arising in the context of self-experience processes, unless a breach of duty is present.
  4. Freelance professionals act independently in a professional and legal capacity. The Institute assumes no liability for content, methods, or therapeutic decisions.
  5. Statutory liability for damages resulting from injury to life, body, or health remains unaffected.
Data Protection
  1. All personal data is processed in accordance with the Institute’s privacy policy in its current version.
  2. Photographs are taken only with consent; objection is possible at any time.
Room Rental
  1. Room reservations are binding.
  2. Cancellation fees:
    ◦ up to 4 weeks prior: free of charge
    ◦ up to 2 weeks prior: 30%
    ◦ up to 1 week prior: 50%
    ◦ less than 1 week prior: 100%
  3. Users are liable for damages caused by themselves or accompanying persons.
Ambulance Mediation
  1. The Ambulance serves to mediate qualified professionals (therapy or counselling).
  2. The Institute is the data controller for the processing of personal data within the mediation process.
  3. The Institute does not provide therapeutic or counselling services but exclusively mediation and organisational services.
  4. After mediation, the respective professional is solely responsible for:
    ◦ data protection
    ◦ appointment scheduling
    ◦ conducting sessions
    ◦ billing
    ◦ documentation
  5. Clients pay fees directly to the professional.
  6. Professionals may charge a cancellation fee for cancellations made less than 24 hours in advance.
  7. The Institute assumes no guarantee for the conclusion, course, or success of the mediated therapeutic or counselling relationship. No specific matching or treatment outcome is owed.
Final Provisions
  1. German law shall apply.
  2. To the extent legally permissible, the place of jurisdiction is the seat of the Institute.
  3. Amendments to these GTC must be made in writing.
  4. Severability clause: Should any provision be or become invalid, the validity of the remaining provisions shall remain unaffected.
